PR: $500,000 Settlement for Trip and Fall on Raised Sidewalk

Plaintiff tripped and fell on a raised sidewalk adjacent to a commercial property in downtown Newark, New Jersey and retained Corradino & Papa, LLC to represent her injuries. Following the accident, Plaintiff was transported to the emergency room via emergency medical service wherein she was treated and released with a closed comminuted three-part fracture of her proximal humerus. Plaintiff followed up with the on-call orthopedist and underwent an open reduction internal fixation of her humerus. As a result of the surgical incision, the Plaintiff sustained scarring on her right upper arm. Plaintiff also asserted a claim for her neck injuries in which she underwent physical therapy and an epidural steroid injection.

The case resulted in significant litigation, depositions, and motion practice. The parties submitted to a Mediation which Plaintiff left due to no meaningful offer being tendered. Plaintiff relied on the opinions of her liability expert to establish the Defendant was on notice of the raised sidewalk and failed to remediate the condition which in turn caused the seventy (70) year old Plaintiff to trip and fall.

Plaintiff sought non-economic damages for suffering, pain, loss of enjoyment of life, disability, and impairment and promptly proceeded with litigating this matter to receive compensation for her injuries in a timely fashion.
